Common DUI Question: How long will my license be suspended?

This is a common question that is asked of DeGiacomo & Mikhlin, P.C., as everyone is concerned about their ability to drive to work. The answer depends on a number of factors. First, did you take a breathalyzer? If so, then your license will be suspended for 30 days at the start of the case. If not, then your license will be suspended for 180 days if it is your first offense, and more if it is a subsequent offense. If you are found not guilty, that’s where the suspensions end. However, if you are convicted, your license will be suspended for an addition 45-90 days on a first offense, two years on a second offense, and even longer for a third or subsequent offense.
