DUI Checkpoints
DUI checkpoints, also known as road blocks, are becoming more common in Massachusetts, including in the Peabody area. DUI checkpoints are run by the Massachusetts State Police, and are used to locate drunk drivers. Typically, the police will shut down a section of a major road, and have a certain number of cars pull off the main road to speak to a trooper. If that trooper believes that the driver has been drinking the driver is then sent to another area for a further investigation.
While the courts have found that DUI checkpoints are constitutional, they have also set strict rules for their use. First, the police must warn the public about upcoming DUI checkpoints by publishing a notice. They also must follow strict rules about how and when to stop motorists. If they fail to follow the rules to the letter, then any arrests they make will be thrown out.
