Underage OUI Laws & Penalties in Massachusetts
In Massachusetts, operating under the influence (OUI) refers to operating a motor vehicle while under the influence of alcohol or drugs. The penalties for underage OUI, also known as "zero-tolerance" laws, are specifically targeted at individuals who are under the legal drinking age of 21.
If an individual under the age of 21 is found to be operating a motor vehicle with a blood alcohol content (BAC) of 0.02% or higher, a first offense carries a driver's license or learner's permit will be suspended for 180 days, or up to one year if the driver is younger than 18 years old. If an underage driver agrees to enter a treatment program, the license suspension period will be reduced or dismissed
However, if an underage driver has a BAC of at least 0.08%, then they will be charged with a standard OUI like an adult driver. A conviction carries a maximum jail sentence of two and a half years, fines of up to $5,000, and license revocation for one year.
