Defending Hospital Blood Draws
One of the hardest pieces of evidence to defend against in an OUI or DUI case is a hospital blood draw. However, that does not mean that they are impossible to defend. First, it is important to have your attorney review your medical records from the night in question. It is common when there is a person transported to the hospital after an OUI that the medical records will mention the police wanting a blood draw to take place. If this is the case, a motion to suppress the blood draw can be filed, as the police need a warrant to request a blood draw.
