How Subsequent Offense OUIs Are Tried
Subsequent offense OUI cases appear to cause a problem: the jury hearing about the prior offense. Luckily, that is not the case. When a person goes to trial on a subsequent offense OUI, there are two trials. In the first trial, the jury will decide if the defendant is guilty of OUI – without ever hearing about the prior offenses. If the jury finds the defendant guilty, then a second trial will occur, at which ether the jury or a judge will hear evidence to determine if the defendant had been convicted on a prior occasion.
For an example of a subsequent offense OUI that Attorneys DeGiacomo and Mikhlin have handled in the Clinton District Court, see Commonwealth v. SB
