  • Case Dismissed January 2025 Case Result – Fall River District Court

    In January 2025, Attorney James G. DeGiacomo represented a client in the Fall River District Court at a Clerk Magistrate’s Hearing. The purpose of the hearing was to determine if probable cause existed to issue a criminal complaint charging the client with four counts of Solicitating Sexual Conduct for a Fee. This matter stemmed from a multijurisdictional investigation in Southeastern Massachusetts of a forced prostitution ring where the police sought charges on over 50 customers. Attorney James G. DeGiacomo was able to show that his client had suffered from mental health issues that lead to the charged behavior, and that given his situation the interests of justice would not be served by issuing the charges. After a lengthy back and forth with the police and clerk magistrate, it was determined that charges would not issue. This result ensured the client would continue to have a clean record, and would not face these serious criminal charges in court.


  • Not Guilty January 2025 Case Result – Brockton District Court
    In January 2025, Attorney James G. DeGiacomo represented a client in the Brockton District Court on charges of OUI (Operating Under the Influence of Alcohol). These charges were initiated after the client was observed by the police to be committing marked lanes violations. After being ordered out of the car and failing the sole field sobriety test, the client was then brought to the hospital where he received a diagnosis of “acute alcohol intoxication” and his blood has close to three times the legal limit of alcohol. At trial, Attorney James G. DeGiacomo was able to successfully keep the blood tests out of evidence. With this significant piece of evidence out, Attorney DeGiacomo then turned his attention to the officer who pulled over the client. Attorney DeGiacomo was able to show that the officer failed to observe numerous signs of intoxication that he was trained to look for in OUI investigations. This successful cross-examination resulted in a finding of NOT GUILTY.
  • Case Dismissed January 2025 Case Result – Salem District Court
    In January 2025, Attorney James G. DeGiacomo represented a client in the Salem District Court at a Clerk Magistrate’s Hearing. The purpose of the hearing was to determine if probable cause existed to issue a criminal complaint charging the client with Leaving the Scene of Property Damage after it was alleged that the client had hit her neighbor’s car when parking. At the hearing, Attorney DeGiacomo presented evidence that the client had attempted to contact the neighbor prior to the police’s arrival, leaving a note about the accident. As a result of this evidence, the clerk found that there was no probable cause and did not issue the complaint, saving the client thousands of dollars in potential fines and fees as well as preventing her from needing to go back to court.
  • Not Guilty January 2025 Case Result – Lynn District Court

    In January 2025, Attorney James G. DeGiacomo represented a client in the Lynn District Court on charges of OUI (Operating Under the Influence of Alcohol). These charges were initiated after the client was stopped at a Massachusetts State Police Check Point. At trial the troopers testified that the client had failed the field sobriety test and was over the legal limit after taking the breathalyzer. During a successful cross-examination, Attorney James G. DeGiacomo was able to show that the troopers had completely deviated from their training during the field sobriety tests, effectively rendering them useless. Furthermore, Attorney DeGiacomo was able to argue that the breath test failed to prove that the client had been over the legal limit when he was actually driving. After a short period of deliberation, the jury returned a verdict of NOT GUILTY.

  • Case Dismissed January 2025 Case Result – Haverhill District Court

    In January 2025, Attorney James G. DeGiacomo represented a client in the Haverhill District Court on charges of Shoplifting after the client was caught on surveillance video taking items from a popular chain department store. At the client’s arraignment, Attorney DeGiacomo was able to discuss the allegations with the prosecutor and secure a dismissal on the case. This outcome ensured that the client would not face any issues at his job where he needed to maintain a security clearance.

  • Case Dismissed December 2024 Case Result – Brookline District Court

    In December 2024, Attorney James G. DeGiacomo represented a client in the Brookline District Court on charges of Assault with a Dangerous Weapon after it was alleged that the client had brandished a knife during an altercation with a couple on the streets of Brookline. During his investigation, Attorney DeGiacomo was able to discover that the couple involved had gotten divorced and moved from the area, knowing this, he quickly scheduled the case for trial where the prosecutor was forced to inform the judge that the witnesses were not present. As a result, the court dismissed all charges.

DeGiacomo represented a client in the Brockton District Court on a charge of Assault and Battery after she was alleged to have gotten into a physical altercation with her sister. DeGiacomo represented a client in the Brockton District Court at a Clerk Magistrate’s Hearing after it was alleged that he was driving without a valid Massachusetts driver’s license. At the hearing, Attorney DeGiacomo explained that his client was a professional who at the time had a valid out of state license and that he was simply mistaken in not realizing that he had to get a Massachusetts license once he moved into the Commonwealth. The clerk accepted this explanation and chose not to issue the criminal complaint. This result saved the client thousands of dollars in potential fines and fees and ensured that his professional license and his driver’s license wouldn’t be placed at risk.
  • Case dismissed October 2024 Case Result – Brockton District Court
    In October 2024, Attorney James G. DeGiacomo represented a client in the Brockton District Court charged with Assault and Battery on a Family/Household Member as well as Assault and Battery on a Police Officer. Attorney DeGiacomo immediately recognized that the client’s girlfriend would not appear for trial, however, such an action would not automatically result in a dismissal of the case as there was also an allegation regarding the officer that had arrested the client. While most police officers always show up to court for trials, Attorney DeGiacomo, being a regular at the Brockton District Court, was aware that the officer in this case often failed to appear. With this knowledge in hand, instead of accepting the prosecutor’s plea offer, Attorney DeGiacomo scheduled the case for trial where, as anticipated, the officer failed to appear, resulting in the case being dismissed.
