Motion to Suppress Based on Unconstitutional Stops
One of the first things that Attorneys DeGiacomo and Mikhlin will do when reviewing a new OUI case is look into whether the police violation the defendant’s constitutional rights during the stop of the motor vehicle. This often occurs when the police stop someone when the don’t have the right to do so. After a hearing, if the judge agrees with Attorneys DeGiacomo and Mikhlin, then all evidence that was obtained after the stop will be suppressed, and the Commonwealth will likely be forced to dismiss the case.
